3. Booking and Reservations
3.1 Booking Process
For booking a charter, you are required to:
- Be at least 18 years of age
- Provide accurate and current information
- Make the necessary deposit as outlined in your booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
Confirmation of your booking is contingent upon payment and our written confirmation. Service can be withheld at our discretion.
3.3 Availability
We offer charters based on the availability of vessels and appropriate weather conditions. We'll attempt to accommodate your preferred dates and timing, within reason.
4. Payment Terms
4.1 Pricing
All fees are quoted in £ and are inclusive of applicable taxes, unless noted. Pricing is subject to alteration without prior notice.
4.2 Payment Schedule
- Deposit: Half the amount of the charter cost is due upon booking
- Remaining balance: Must be paid 48 hours before the charter starts
- Incidental charges (if any): Settled after the charter is complete
4.3 Payment Methods
We process payments through several methods, including major credit cards, bank transfers, and certified cheques, within secure and encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Full refund less processing expenses if cancelled more than 72 hours in advance
- Half the refund if cancellation occurs between 24-72 hours before departure
- No refund if cancellation is less than 24 hours before departure
5.2 Weather Cancellations
In scenarios where our captain deems the weather unsafe, these options are offered:
- Reschedule the charter at no extra expense to the nearest available slot
- Provide a complete refund if no rescheduling can be arranged
5.3 Mechanical Issues
If there's a mechanical failure with your assigned vessel, we will strive to supply a comparable substitute. A complete refund will be given if providing a substitute is unfeasible.
6. Safety and Conduct
6.1 Safety Requirements
All guests are expected to:
- Adhere to all instructions from the crew
- Wear any required safety gear
- Disclose any medical conditions that may compromise their safety
- Stay within the designated areas while onboard
6.2 Prohibited Items
The following are not allowed on board:
- Glass containers
- Illegal substances
- Weapons or firearms
- Excessive alcohol beyond what's deemed reasonable consumption
- Pets (exceptions allowed if pre-approved)
6.3 Conduct
Guests should behave respectfully. Should passengers exhibit conduct deemed unsafe or disruptive, the charter may be terminated prematurely with no refund.
7. Liability and Insurance
7.1 Our Liability
Liability on our part is restricted to the charter fee paid. We deny liability for:
- Injuries caused by passenger negligence
- Loss or damage of personal belongings
- Non-direct, consequent, or punitive damages
- Delays from weather or unforeseen circumstances
7.2 Insurance Coverage
We sustain full marine insurance coverage for our vessels and operations. It is the responsibility of passengers to have their own travel and personal insurance.
7.3 Assumption of Risk
You accept the inherent risks associated with marine activities and assume responsibility for your own safety and health by participating in our charters.
8. Modifications and Itinerary Changes
Itineraries, routes, or schedules may be altered due to weather, safety concerns, or operational needs. We commit to ensuring a comparably equivalent experience is provided in case of such modifications.
9. Force Majeure
We hold no accountability for disruptions due to forces beyond our control, such as but not limited to:
- Severe weather events
- Natural catastrophes
- Government directives
- Port shutdowns
- Vessel breakdowns
10. Privacy and Data Protection
We manage your personal data in accordance with our Privacy Policy. You consent to the utilisation and collection of your details as specified in our Privacy Policy by using our services.
11. Intellectual Property
Contents on our website, such as text, images, logos, and graphics, are under copyright and trademark protections. You are prohibited from reproducing, sharing, or making derivatives without our direct consent.
12. Governing Law
